Minutes of January 7, 2004 Meeting

Meeting started at 6:00 pm and adjourned at 7:15 pm.  Held at Charlie’s home.

 

Walmart Update

Received responses from 12 of the 100 petitions stuffed in mailboxes.  The January 12 annexation and rezoning meeting has been postponed until February 9.  Lynn Gray (attorney) will attend Greenwood hearing and a January 26 meeting in Johnson County related to the Alderson property.  The plan will be to defeat them at the hearing level.  Gerry is going to read the file and the statutes to see if there is any wiggle room for us.  He knows that greater than 51% or 100% of the property owners must be signatures on the petition.  They hope to get an attorney to share the strategy.  Lynn is dealing directly with the organizer of this homeowner’s Walmart group.  Gerry has included her in various e-mails, sharing his thoughts and ideas.  This group received our first $500 for this cause.  We could also go directly to city of Greenwood and raise concern.  Lynn Gray suggested backing off on this type of activity.  Gerry contacted Judy Hoeping to see if she has any data related to property value impact if Walmart store goes in.  There will be a January 19 meeting with Lynn Gray to see where things stand.  There is also interest in conducting a state road study to see the impact of additional traffic and ongoing expenses for roads.  We might want to consider getting involved with Walmart and setting restrictions on building and façade if we lose this.

 

Architectural Committee

Brian Benham attended meeting and expressed interest in chairing the Architectural Committee.  Board members approved his appointment.  Other names provided as having expressed interest are Mike Abduhlah, Bruce Bender, Steve Plummer and Fritz Wurster.  After official transfer of association responsibilities to the Board, Brian will notify these individuals to let them know that they have been selected to serve on the committee.

 

Greg Allen Issues/Transfer of Association Responsibilities

Brockton Manor Board wants to assess 82 of the 100 lots to pay maintenance of the Brockton Manor lake.  Kristy is having the contract changed to reflect a flat fee per year.

 

Punch list letter was sent to Greg Allen’s office on January 6, 2004.  Letter included John’s letter, a copy of the original letter sent to Greg Allen concerning the lake problems and a copy of the certified receipt for that original letter.  If no response by Friday, John will make 1 follow up call.  If still no response, he will send a demand letter by Monday. 

 

Miscellaneous

R&G Management followed up with us to see why we haven’t signed their contract yet

 

Do we want Pat Beach (All Pro Pump & Repair) to take a look at the lake situation?  We will wait until we have a response back from Allen’s office to make that decision.

 

E-gix is a voicemail box not tied to a phone.  Can go to any e-mail box account we set up.  The cost is $6.95/month. 

 

We may want to consider a website for Highland Park.  Scott Cassin will research our options.

 

Need to contact Wayne Kissler regarding D&O insurance.

 

John will request from R&G – revised budget, hired bids, D&O insurance rollover.

 

John will have Sean take a look at current covenants.

 

John Griffin received letter of response from Allen’s office and wants to meet with Dennis to review.

 

We may want to consider sending a newsletter to the h.o.’s to reiterate the section of the covenants that applies to signage.  Do we need to establish a sign procedure?  Do we need to amend current wording?  Brian will review that section of the covenants and will report back with a recommendation. 

 

John and Charlie will meet with Greg Allen regarding next steps.  Sean (attorney) believes Greg Allen will not immediately respond but may respond upon receipt of a demand letter.

 

Date and time of next meeting will be determined after John and Charlie meet with Greg Allen.
