Meeting started at 7:00 pm and adjourned at 8:50 pm.
Received a brief update from our homeowner representing the Walmart concerns, Gerry Smith. Several of the local H.O. Associations have come together to attempt to share legal expenses for the Walmart fight. This group has asked for a specified dollar amount from each homeowner to retain the attorney so our interests are represented. The Eagle Trace H.O. Association wants to administer the fund for money coming in and paid out. Money would be kept in a separate fund and would be returned to H.O.s if money remains. The Board is take this under advisement. The next meeting of the Walmart group will be December 15 or 16 and Gerry wanted the approval to go ahead and pay the first small amount to retain the attorney. The Board approved this payment.
Reviewed November’s expenses and finances. Received
Discussed the waterfall pump. Ballard has looked at the lake and indicates that the pump should come out every winter, lights should be repaired, the pumps should be cleaned and put back in the spring. For $350 Ballard will clean, check, store and remove in winter and install in the spring. There may be add’l charges for upgrade in electrical, etc. The other two water units by Dockside drive will be a shared expense with Brockton Manor. Dick Ballard does not believe the originally installed pump was the proper pump for this lake situation. Ballard will charge $10,265 to install a new pump. Keith Leistner inspected the pump and reported it broken and disconnected. His bid would match Ballard’s.
Reviewed 2004 Bids. Received a Bid Summary Sheet from R&G Management. Verbally added: Lawn Mowing: Kenny Pluntz $150/Primary Care $150/Jim the Gardener $135. Decided the best bids were: Lawn Mowing – Jim the Gardener, Lake Care – Leistner, Irrigation – Ballard. We agreed that Greg Allen needs to agree that the common areas can be cut as often as other areas in the subdivision and that it can be done by the same contractor.
Reviewed the proposed budget. Received Highland Park H.O., Inc. 2004 Proposed Budget from R&G Management. Made the following adjustments:
Lawn Care - $11,550 (Lawn treatment $1,250/flowers $2,000)
Add reserve fund for capital improvement
Walmart Fees $2,600
Move $1,280 to new reserve fund
New budget = $46,856/128 lots = $366.06 per yr; round up to $380
$380 x 128 lots = $48,640; $46,856 expenses; move $1,280 to reserve fund
We need to check into D&O coverage to protect Board Members from lawsuits. R&G Management indicated that coverage is currently in place. They will ensure that we have coverage when responsibilities are transferred.
Brockton Manor will provide a proposal to share in the cost of maintaining lakes in the back of Highland Park. There are 8 families on those lakes.
We need to decide if we want an attorney to look at the current H.O. Association contract to see what we are accepting. Biggest issue is changing second amendment (Brockton Manor shares). Sean Clapp is the attorney suggested to draw up changes.
Proper repair of lake, pump and fountain must be addressed before we accept transfer of responsibilities. Need to put Greg Allen on notice that we have issues that need addressed. We need to develop a punch list that includes all issues. Lisa, Scott and Jeff will prepare punch list of all items except the lake summary. Charlie and John will prepare summary of lake issues.
